1.2This document (“Fair Use Policy”) sets out the terms of fair use for Okke and associated services (together the “Services”) provided by Money Management Group Pty Ltd (ABN 56 008 131 137) trading as okke (“we”, “us”, or “our”) to its customers (“your or your”).
1.3 The purpose of this Fair Use Policy is to ensure that all users of our Services:
a) are able to reasonably access our Services; and
b) do not use our Services in a manner that we would consider unreasonable or unacceptable.
1.4 For the avoidance of doubt, the SaaS Terms operate in conjunction with this Fair Use Policy.
1.5 By accessing and/or using our Services, you agree to be bound by the terms of this Fair Use Policy.
2. Acceptable use
2.1 You must only use the Services lawfully, for use in the ordinary course of business and at all times in compliance with all applicable terms and policies.
2.2 You must not use the Services in a manner which is unreasonable or unacceptable.
3. Unreasonable Use
3.1 We consider your use of the Services to be unreasonable if you use it in a manner that is contrary to the way we intended the Services to be used.
3.2 Set out below are examples (note that this is not an exhaustive list) of what we consider to be unreasonable use of the Services, using the Services:
a) for any activity that breaches any applicable laws or regulations;
b) for fraudulent purposes;
c) in a way that will interfere with, interrupt, manipulate, bypass or degrade the Services;
d) in a way that infringes the rights of other persons;
e) using the Services in a way that a reasonable person would not regard as ordinary;
f) using the Services for re-supply to another person;
g) in a way which could not be reasonably regarded as ordinary business use;
h) to excessively cancel and/or subscribe to our Services; or
i) to excessively take advantage of pricing or offers, for example by signing up to the Services with multiple accounts.
4. Unacceptable Use
4.1 Set out below are examples (note that this is not an exhaustive list) of what we consider to be unacceptable use of the Services, using the Services in a way:
a) that adversely affects the system or network which supports the Services (System), for example by causing disruption or sub-optimal performance;
b) which overloads the floods the System or probing or testing the vulnerability of the System; or
c) that adversely affect any person’s use of the Services.
5. Breach of the Fair Use Policy
5.1 If you breach any part of this Fair Use Policy, we will contact you and, if appropriate, ask you to modify your use of the Services. If you do not modify your use of the Services to our satisfaction within the timeframe stipulated by us, we may suspend or cancel your ability to access the Services without further notice to you.
5.2 In certain circumstances such as illegality, or a serious breach, we reserve the right to limit, suspend or cancel your access to the Services immediately, without notice to you.
5.3 We may also take any other action against you that we deem appropriate in the circumstances.
5.4 Upon cancellation of your access to the Services, we are authorised to immediately delete any files or data associated with your account (without having regard to whether you have made a back-up copy of the file or data).
5.5 We reserve the right to apply this Fair Use Policy at our absolute discretion and on a case-by-case basis.
6. Changes to our Fair Use Policy
We may amend this Fair Use Policy at any time (without notice to you) by uploading the updated Fair Use Policy to our website located at www.okokke.com and its directly associated domains (together the “Website”). You should read our Fair Use Policy each time you deal with us so that you are aware of any changes made to it as they are legally binding on you.
